1. Who we are

Spend It! · THE Abundance App ("Spend It!", "we", "us") is operated by Cynthia Preston ("the Seller"). By creating an account or using Spend It! you agree to these Terms & Conditions.

2. Acceptance

By accessing, signing up for, or continuing to use Spend It! you agree to be bound by these Terms. If you do not agree, do not use the service.

3. The service

Spend It! is a mindset journaling tool that invites you to imagine spending a daily escalating budget. The service is provided for personal, non-commercial use. You must be of legal age in your jurisdiction to use it.

4. Acceptable use

You agree not to misuse the service, including but not limited to:

  • Any unlawful, fraudulent, or spam activity;
  • Infringing intellectual property or the rights of others;
  • Interfering with security (malware, probing, scraping, denial of service);
  • Reverse engineering, reselling, or redistributing the service;
  • Circumventing technical limitations or the paywall.

5. Your account

You are responsible for keeping your credentials confidential and for any activity under your account. Please provide accurate information and keep it up to date.

6. Intellectual property

The Seller retains all rights in the Spend It! software, content, branding, and design. You are granted a limited, non-exclusive, non-transferable right to use the service for its intended purpose.

7. Service level

The service is provided "as is." We do not guarantee that it will be uninterrupted, error-free, or available at all times. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

8. Payment and subscription terms

Spend It! is offered as a one-time purchase for full access; there is no recurring subscription. Payment, billing, tax, cancellation, and refund mechanics are governed by our payment provider's terms — see Paddle's Buyer Terms and our Refund Policy.

9. Paddle — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

10. Suspension and termination

We may suspend or terminate your access for material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time; you may also delete your account from the in-app Account page.

11. Limitation of liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees you paid to us in the twelve (12) months preceding the claim. We are not liable for indirect, incidental, consequential, special, or punitive damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, or personal injury caused by negligence, where such limitation is not permitted by law.

12. Governing law

These Terms are governed by the laws of the Seller's jurisdiction, without regard to conflict of law principles. Disputes will be resolved in the courts of that jurisdiction, unless applicable consumer law provides otherwise.

13. Changes to these Terms

We may update these Terms from time to time. Continued use of the service after changes take effect constitutes acceptance of the revised Terms.
